Canon Obtains Three Preliminary Injunctions

Canon has announced on February 12, 2019, that the District Court Düsseldorf granted a preliminary injunction against Doree Supplies B.V., doing business as “AppleToner,” as well as against its managing directors. The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge. The preliminary injunction enjoins Doree Supplies B.V. from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, via, for example, www.amazon.de. The infringing cartridge can replace the OEM cartridge model HP CF280A which is compatible with HP laser beam printers.

Just a week before this announcement, the company also obtained another two preliminary injunctions against Nixim Europe Limited and Media Range GmbH.

Nixim Europe is trading as “Top Cartridge”, and Media Range GmbH is trading as “MediaRange”. Both companies infringed the German portion of Canon’s European patent EP 2 087 407. The infringing cartridges can replace the OEM cartridge models HP CE505A, HP CE505X, HP CF280A and HP CF280X, which are compatible with HP laser beam printers.

According to Canon, defendants have the option to file an objection against the preliminary injunction. However, as service on Defendants was effected, Canon can enforce this decision.
