Remanufacturing Foreign Cartridges Confusion -Berto gets caught at the border
Prior to 2017, there was confusion about the patent rights OEMs had after they had first sold their printer cartridges to the consumer in the USA.
The aftermarket was challenged in a number of court cases about remanufacturing empty printer cartridges that had been sold both inside and outside the USA. The most notable case was the seven-year legal fight between Lexmark International and Impression Products in West Virginia, USA which ended up in the Supreme Court of the United States. A ruling in favor of Impression Products was made on May 30 2017. The boss of Impression Products, Eric Smith, stood alone from the 60 companies that were sued for using empty Lexmark cartridges imported from Canada.
