Ninestar Quits Canon ‘337 Investigation in the USA
Lawyers representing Ninestar Corporation, Ninestar Image Tech Limited, Ninestar Technology Company, Ltd., (Ninestar) have issued an official Notice of Intent to Default with the US International Trade Commission (USITC).
In documents dated June 10, 2021, and sent to RT Media and ImagingWorld magazine, Administrative Law Judge, the Honorable Clark S. Cheney has been advised that Ninestar, and its subsidiaries including Static Control Components, Inc. “intend to raise no further defense in this investigation and default.”
Static Control Components Inc (SCC) made an announcement via a statement to industry media on June 10 (US eastern seaboard time zone). At the same time (on June 11, 2021, China time), lawyers representing Ninestar issued their notice to the USITC.
The Ninestar withdrawal has come in response to the company and its subsidiaries being named in an investigation under section 337 of the Tariff Act of 1930, as amended, over the alleged infringement of Canon’s patents used in certain toner supply containers and components.” Canon was seeking orders from the USITC including a general exclusion order (GEO) and cease-and-desist orders.
Ninestar’s brief Notice of Intent to Default to the USITC in the matter of Investigation No. 337-TA-1259: CERTAIN TONER SUPPLY CONTAINERS reads:
RESPONDENTS NINESTAR CORPORATION, NINESTAR IMAGE TECH LIMITED, NINESTAR TECHNOLOGY COMPANY, LTD., AND STATIC CONTROL COMPONENTS INC.’S NOTICE PURSUANT TO 19 C.F.R. § 210.17(h) OF INTENT TO DEFAULT
Pursuant to 19 C.F.R. § 210.17(h), Respondents Ninestar Corporation, Ninestar Image Tech Limited, Ninestar Technology Company, Ltd., and Static Control Components, Inc., (collectively, the “Respondents”), having considered the limited volume of sales of the accused products and other solutions that the Ninestar Respondents offer for the market, and without conceding any issues or admitting that any unfair act has been committed under Section 337, 19 U.S.C. §1337, hereby give notice that they intend to raise no further defense in this investigation and default.
