Katun Responds To Canon’s European Patent Lawsuit
Recently, Canon filed a complaint against Katun and GPI with the Local Division Düsseldorf of the Unified Patent Court asserting potential patent infringement of Canon’s European Patent 3 686 683 B1 (“EP’683”).
“Katun is confident the products it is selling and distributing for use in Canon applications are non-infringing and will work diligently to reach a resolution on the issue with Canon,” said William McIntyre, General Counsel for Katun Corporation.
“For more than 45 years, Katun has led the aftermarket industry in providing IP-compliant, high-quality products,” continues McIntyre. “Working together with our owners, GPI in Taiwan, we continue to invest significant resources into ensuring IP-compliance, including using robust processes and procedures, employing several intellectual property specialists, and relying on our significant subject matter expertise.”
Canon’s Statement of Claim claimed that several toner bottles used in Katun’s models infringed the patent EP’683 claims. Katun’s products were initially designed for use in Canon’s printers and copiers and are hence compatible with Canon’s respective OEM products. According to Canon’s complaint, Katun’s products contain features specifically defined in the patent EP’683 claims, thus appropriating its technique.
