Armor Will Defend its Position Against Canon’s Complaint
As one of the defendants mentioned in the German patent complaint filed by Canon, Armor issued a statement, saying it “will defend” its position based on the background of this complaint.
According to Armor, “In the meantime we would like to state that the current remanufacturing process of Armor uses OEM’s ‘dongle gear’ couplings only and respects the intellectual and industrial property rights of third parties. In practical terms Armor certifies that today any remanufactured laser cartridge produced in its production facilities are respectful of Canon patents and that there are no related risks to purchase the said products.”
Back on December 15, Canon published a press release, claiming Armor SA”, “Artech GmbH”, the “Pelikan Vertriebsgesellschaft mbh & Co. KG” and other Pelikan companies infringe its European patent 2,087,407 by offering and selling certain toner cartridges for Hewlett-Packard laser beam printers.
The European patent 2,087,407 (No. EP2,087,407 B1), which was filed on December 25, 2007 and was published on July 17, 2013, protects the drum unit, process cartridge and printer components of laser printers. Those components are related to the invention theory of “Dongle Gear”.
The 32 states this patent covers include: Australia, Belgium, Bulgaria, Switzerland, Cyprus, Czech Republic, Germany, Denmark, Estonia, Spain, Finland, France, United Kingdom, Greece, Hungary, Ireland, Iceland, Italy, Liechtenstein, Lithuania, Luxembourg, Latvia, Monaco, Malta, Netherlands, Poland, Portugal, Romania, Sweden, Slovenia, Slovakia, and Turkey.
