Canon Continues Removal Requests

Canon Inc. announced the filing of two Report Infringement Forms with Amazon UK in just one day.

One is based on the alleged use of claims 1 and 2 of the UK portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models CE410A, CE411A, CE413A, CC530A, CC533A and CF210A offered by 3WM Office Supplies under the ASINs (Amazon Standard Identification Numbers) B00A6U6OCW, B00A6U6OXQ, B00A6U6PIA, B002RDYJGO, B00HW0JPWK and B002RDWXUS. Afterwards, Amazon took down the respective products.

These products are compatible with the above OEM HP cartridge models CE410A, CE411A, CE413A, CC530A, CC533A, CF210A and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

The other one is based on the alleged use of claims 1 and 2 of the UK portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models CE410A, CE411A, CC530A, CC531A, CF383A and CF210X offered by Neqtiq. under the ASINs (Amazon Standard Identification Numbers) B00A6U6OCW, B00A6U6OXQ, B002RDYJGO, B002RDV52U, B01ALPOUTK and B00HW0JQL. Afterwards, Amazon took down the respective products.

These products are compatible with the above OEM HP cartridge models CE410A, CE411A, CC530A, CC531A, CF383A, CF210X and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

On the same day, Canon Inc. announced the filing of an infringement report with Amazon.com seeking the removal of Amazon.com listings for certain toner cartridges sold by MENGYAN STORE for use in HP laser beam printers.

Canon’s infringement report alleged that certain model CE320A, CE321A, CE322A and CE323A toner cartridges sold by MENGYAN STORE via Amazon.com infringed Canon’s U.S. Patent No. 8,588,646. Canon requested that Amazon remove MENGYAN STORE’s listings for those products, namely, MENGYAN STORE’s listings with Amazon Standard Identification Numbers (“ASINs”) B0818R482R, B0818QZPF7, B0818R14BF and B0818RQJJR.

At the time of this announcement, the above-identified MENGYAN STORE listings were no longer available on Amazon.com.
