Canon Files Infringement Report Form with Amazon Again
Canon Inc. claims that it has filed an Infringement Report Form with Amazon.de based on the alleged use of claim 1 of the German portion of Canon’s European Patent EP 3 270 230 (“EP ‘230”) regarding certain toner cartridges offered by zhu hai chuang yue xin ke ji you xian gong si under the following ASIN (Amazon Standard Identification Number).
The reported cartridges are intended for use in HP printers and are compatible with OEM HP cartridges. The cartridges contain new – non-OEM – components, including the housing of the first and second unit, the urging portion and the force receiving portion according to claim 1 EP ‘230. As a result of the Infringement Reports, Amazon removed the respective cartridge offers.
Filing an Infringement Report with Amazon is a service offered by Amazon and doesn’t comprise any official finding of validity or infringement of a patent. The decision to take down a product is at the discretion of Amazon and is based on information provided by Canon. Amazon informed the vendor about the takedown and the vendor may object to it.
According to Canon, it has removed 2224 listings from Amazon in Germany, Italy, Spain, the United Kingdom, France, The Netherlands and Turkey in the fourth quarter, through Amazon Reporting Tool, and letters of inquiry and/or information letters.
Since June 2018, the total number of listings removed from Amazon in Germany, Italy, Spain, the United Kingdom, France, The Netherlands and Turkey is 26,306. The listings offered third-party laser toner cartridges from vendors which Canon believes infringed on one or more of European Patent No.2 087 407, European Patent No. 2 137 577, European Patent No. 1 977 289, European Patent 3 470 931 and European Patent No.3 270 230.
