Canon Flags it will Continue Amazon Takedowns in 2022
Canon Inc. announced on January 31, 2022, it had filed an Infringement Report Form with Amazon.de in Germany.
The iconic Japanese imaging company set the tone at the beginning of 2022 with swift action requesting the removal of allegedly infringing toner cartridges placed on the German Amazon site by xianshi yanliangqucanranbaihuoshanghang (try pronouncing that!).
In a statement from Tokyo, Canon said the takedowns request is, “based on the alleged use of claims 1 and 44 of the German portion of Canon’s European Patent EP 3 470 931 (“EP ‘931”) regarding certain toner cartridges … under the following ASIN (Amazon Standard Identification Number):
“The reported cartridges are intended for use in HP printers and compatible with OEM HP cartridges. The cartridges contain new – non-OEM – components, including the housing comprising a slit, the photosensitive member, the coupling portion and the gear portion according to claim 1 and claim 44 of EP ‘931. As a result of the Infringement Report, Amazon removed the respective cartridge offer.
“Filing an Infringement Report with Amazon is a service offered by Amazon and doesn’t comprise any official finding of validity or infringement of a patent. The decision to take down a product is at the discretion of Amazon and is based on information provided by Canon.
“Amazon informed the vendor about the takedown and the vendor may object to it.”
