Canon Obtains Preliminary Injunction
Canon Inc. announced that the District Court Düsseldorf granted a preliminary injunction against Shenzhen Meisen Automation Equipment Co. Ltd., doing business as “Myth Land”, as well as against its managing director.
The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge. The preliminary injunction enjoins Shenzhen Meisen Automation Equipment Co. Ltd. from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, e.g. via www.amazon.de. The infringing cartridges can replace the OEM cartridge models CE505A, CF280A and CE255A, which are compatible with HP laser beam printers.
Defendants have the option to file an objection against the preliminary injunction. However, as service on the Defendants was effected by public service, Canon can enforce this decision.
Previously, Canon obtained a judgement of acceptance (docket no. 4a O 33/19) issued by the District Court Düsseldorf in the patent infringement proceedings against the German company Tito-Express IP & Marketing GmbH, doing business as “Tito-Express”, and its managing director after Defendants acknowledged all claims asserted by Canon.
