Canon Prevails in Patent Lawsuits
Canon announced it has won lawsuits against Korean organic photoreceptor (OPC) drum maker AlphaChem in Korean Supreme Court. As dlsclosed, the Korean Supreme Court affirmed the Seoul High Court’s ruling of infringement in the patent infringement action against AlphaChem. The Supreme Court agreed with the Korean Patent Court’s ruling that the claims of Canon’s Korean Patent No. 258,609 for OPC drums are valid.
The Supreme Court also supported the Seoul High Court’s decision finding that the Korean Trade Commission’s ruling of patent invalidation in favor of five Korean photoreceptor drum makers should be revoked.
In addition, Canon said the Korean Supreme Court’s decisions are final and cannot be appealed. Therefore, “the ruling of patent infringement against AlphaChem is final and AlphaChem can no longer make or sell the infringing photosensitive drums.”
Again, Canon noted it “respects the intellectual property of other companies and individuals and expects others to similarly respect Canon’s intellectual property rights”. Also, the OEM said it “remains committed to pursuing legal enforcement against those who do not respect Canon’s intellectual property.”
