Canon Requests More Removals from Amazon
Canon Inc. has filed another infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Pro-autoparts for use in HP laser printers.
Canon alleged that certain model CF350A, CF351A, CF352A and CF353A toner cartridges sold by Pro-autoparts via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Pro-autoparts’ listings for those products, namely, Pro-autoparts’ listings with Amazon Standard Identification Numbers (“ASINs”) B07Z3CXYN4, B07Z3FTTB6, B07Z3GWJK7, B07Z3G1KGM and B07Z3GKXVH.
At the time of Canon’s announcement, the above-identified Pro-autoparts listings were no longer available on Amazon.com.
On the same day, Canon filed a report infringement form with Amazon.com.au based on the alleged infringement of claim 28 of Canon’s Australian Patent Number AU2007205464 regarding the cartridge models CC530A, CC531A, CC532A, CC533A, CB540A, CB541A, CB542A and CB543A offered by tonerworld aus under the ASINs (Amazon Standard Identification Numbers) B07JKX9L6Q and B07JKXW3DY.
After receipt of the Report Infringement Form, Amazon took down the respective products. These products are compatible with the OEM HP cartridge models and provide a non-OEM housing and a non-OEM force receiving device according to claim 28 of AU2007205464.
Meanwhile, it also filed report infringement forms with Amazon.de based on the alleged use of claims 1 and 2 of the German portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models CE410X, CE411A, CE412A and CE413A offered by Soldcrazy Germany Distribution GmbH under the ASIN (Amazon Standard Identification Number) B07QTK92H5. Afterwards, Amazon took down the respective products. These products are compatible with CE410X, CE411A, CE412A and CE413A and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon. Amazon informed the vendor about the takedown and the vendor may object to it.
