Canon Sues Katun & GPI for Patent Infringement
Canon Inc. announced that it has filed a lawsuit against Katun and its subsidiaries in Germany and GPI for infringement of Canon’s patent. The case (UPC_CFI_351/2024) was filed before the Local Division Düsseldorf of the Unified Patent Court.
The patent (EP’683”), due to its unitary effect, provides uniform protection in all 17 member states that have ratified the Agreement on a Unified Patent Court. In addition to the lawsuit, Canon is also moving for an injunction and a declaratory judgement on liability for damages under 17 jurisdictions.
In Canon’s Statement of Claim, it claims that several toner bottles used in Katun’s models have infringed claims of the aforementioned patent EP’683. These products of Katun are initially designed for use in Canon’s printers and copiers and hence compatible with Canon’s respective OEM products. According to Canon’s complaint, Katun’s products contain features that are specifically defined in the claims of EP’683, thus appropriating its technique.
GPI, the ultimate owner of Katun, acquired the company in 2018. It is also a manufacturer and supplier of printer consumables itself. Currently, Katun’s products are distributed across Europe through online shops and its subsidiaries. By filing the case, Canon seeks to minimize the effect caused by the infringing product in Europe and respect its intellectual properties. Further details of the lawsuit, including date of proceeding and hearing procedures, are yet to be disclosed.
