Dr. Katja Dauster: Traders in Counterfeit Cartridges in Germany Will Face Five Years in Jail
At Conference@2013, German patent attorney Dr. Katja Dauster reported on the definition of a counterfeit cartridge according to the German Customs Office. That authority states, “Counterfeiters use the reputation of a trademark, which brand manufacturers have built up on the basis of the quality of their products, to fool consumers about the true origin and quality of the goods.”
In addition, Dr. Dauster noted that those trading in counterfeit cartridges in Germany face punishment of up to five years’ in jail. Since clone products are not equal in quality to remanufactured consumables, Dr. Dauster said the cartridges sold will be permitted to be repaired, thereby creating an opportunity for the German remanufacturing industry.
On the other hand, Dr. Dauster told Recycling Times that clone products in Europe will have a negative impact on the industry, because they are produced and sold under the OEMs’ brand names, but will fail those customers who expect the quality of a true OEM consumable.
