Employees Unpaid Case Granted Final Certification

A collective action which saw staff making claims for unpaid overtime wages from their boss has been granted final certification.

As reported by BusinessWire, the number of plaintiffs is over 300, who had worked as assistant store managers for Office Depot from 2000 to 2013. They claimed that Office Depot had paid for their overtime wages in the wrong way according to its “fluctuating workweek” plan from 2005 to 2012. The plaintiffs alleged that the company’s payment method has violated the state and federal wage and hour laws.

One partner from the Locks Law Firm who represents the plaintiffs, Michael Galpern said, “It’s unconscionable that big corporations and other major employers are willing to take advantage of their employees, many of whom are struggling every day just to make ends meet.”

Galpern revealed that he and other lawyers will firmly protect the workers’ rights of seeking to get back unpaid wages to which they are entitled.
