Epson Stops the Infringement of Two Patents

Three Epson companies filed a complaint to the U.S. District Court, District of Oregon (Portland) for a patent infringement by a California-based company.

According to the legal document provided to RT Media, plaintiffs, including Seiko Epson Corporation, Epson America Inc. and Epson Portland Inc. (collectively Epson) sued California-based Gaea Supplies Corp. (Gaea) for the violation of general exclusion orders (GEOs) of the investigation No. 337-TA-565 and investigation No. 337-TA-946 conducted by United States International Trade Commission (USITC).

Epson believes “Gaea does business online as “toner4usa” through at least its listings on Amazon and on eBay, using at least the online seller name toner4usa.” Also, Epson said that “directly through Amazon and eBay, Gaea offers for sale and sells ink cartridges that infringe the Epson patents.” Hence, Epson filed a complaint, suing Gaea for infringement of Epson’s United States Patent No. 6,502,917 (‘917 patent) and Patent No. 8,794,749 (‘749 patent). ‘917 patent and ‘749 patent relate to the investigation No. 337-TA-565 and investigation No. 337-TA-946 respectively.

As revealed by the legal document, products covered by the ‘917 patent include but not limited to ink cartridges having model nos. 126-1, 126-2, 126-3, 126-4, 200XL-1, 200XL-2, 200XL-3, 200XL-4, 78-1, 78-2, 78-3, 78-4, 78-5, 78-6, 273XL Black, 273XL Photo Black, 273XLCyan, 273XL Magenta, 273XL Yellow, T676XL1, T676XL2, T676XL3, and T676XL4, as well as others that are no more than colorably different from the foregoing. Likewise, products covered by the ‘749 patent include “but not limited to ink cartridges having model nos. 126-1, 126-2, 126-3, 126-4, 200XL-1, 200XL-2, 200XL-3, 200XL-4, 78-1, 78-2, 78-3, 78-4, 78-5, 78-6, 273XL Black, 273XL Photo Black, 273XLCyan, 273XL Magenta, 273XL Yellow, T676XL1, T676XL2, T676XL3, and T676XL4, as well as others that are no more than colorably different from the foregoing.”

Epson is asking the court to order Gaea stop the continued infringements of Epson’s patents. Also, Epson demanded that Gaea should pay for the damages such infringements have caused Epson. In the complaint, Epson requested a trial by jury of all issues.
