Esquared Trading LLC, an Amazon reseller based in New Jersey, has filed a lawsuit against Sharp Corporation and its U.S. distributor, Victor Technology LLC.

The lawsuit alleges that the defendants falsely claimed that Esquared’s products on Amazon violated Sharp’s intellectual property rights, which led to the removal of Esquared’s listings from the platform.

Filed on August 8, the lawsuit accuses Sharp and Victor of making baseless intellectual property infringement claims that resulted in Amazon banning Esquared from selling legitimate Sharp products. The complaint also includes allegations that Sharp and Victor conspired to control the prices of Sharp products on e-commerce platforms like Amazon. As part of this alleged strategy, the defendants are accused of submitting false reports to these platforms, leading to the removal of numerous Sharp products, similar to what Esquared experienced. The lawsuit states that Sharp and Victor wrongfully accused Esquared of selling counterfeit Sharp items, even though the products were authentic and legally sourced.

Esquared’s legal team argues that Sharp and Victor took advantage of Amazon’s policy of swiftly acting on intellectual property complaints without thorough investigation, fully aware that this would damage competitors like Esquared. The lawsuit claims that these actions were part of a larger scheme to stifle fair competition and artificially inflate prices by limiting the presence of third-party sellers on the marketplace.

Esquared is seeking a declaratory judgment to confirm that it did not infringe on any trademarks, an injunction to prevent Sharp and Victor from making further false claims, and compensation for damages, including lost business and harm to its reputation. Additionally, the company is requesting a jury trial to address the alleged defamation and interference with its business operations.
