Canon Asks for More Takedowns
Canon continued its efforts in fighting against infringement, seeking certain toner cartridges to be removed from Amazon listings in Europe, Canada and Mexico.
Canon Inc. filed Report Infringement Forms with Amazon.co.uk and Amazon.es based on the alleged use of claims 1 and 2 of the UK and Spanish portions of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding certain models of toner cartridges offered by Plumeria Ecom under the following ASINs (Amazon Standard Identification Numbers).
Afterwards, Amazon took down the respective products. These products are compatible with the above-identified OEM HP cartridge models and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.
Canon’s infringement report alleged that certain model CB540A, CB541A, CB542A, CB543A, CC530A, CC531A, CC532A and CC533A toner cartridges sold by Gotoners via Amazon.ca infringed Canon’s Canadian Patent no. 2,635,791. Canon requested the removal of the corresponding listings for these products, having Amazon Standard Identification Numbers B07MMPPSVS and B086V5GDJ1.
At the time of this announcement, products sold under the above identified listings were no longer available on Amazon.ca.
Canon’s infringement report alleged that claim 160 of Mexican Patent Number 308881 was infringed by certain model CE255A toner cartridges offered by Psa Computo y Papeleria under the Amazon Standard Identification Number (ASIN) B07BR6S6GR.
After receiving Canon’s Report Infringement Form, Amazon removed the respective products, and at the time of this announcement, the above-identified listings of Psa Computo y Papeleria were no longer available on Amazon.mx.
